What is a claim letter? 

It is a demand letter to another party asking for money to be paid in the case of an incident. A claim letter implies a request to another party for refund or replacement in the case of an insurance plan. It can serve as a legally binding form of communication that can be used as evidence in court if the other party does not help the claim. This post will enlighten us on how to write a letter for car accident claims.

Why is it necessary to send a Claim Letter?

You may wish to claim against another party who was involved in an accident with you and is entirely at fault. Sending a claim letter to communicate the cost of the damage to your car and stating that the other party is at fault is the right thing to do to convince the other party to pay. 

The other party may reply with an adjustment letter to settle or negotiate the claim, saving you the time and cost of a court case. If eventually, you go to court, the claim letter you sent would serve as evidence that you asked for payment civilly for the repairs of the damage caused. 

You may also wish to claim your insurer to cover for damage costs incurred when you might be at fault in a car accident. Sending a claim letter to communicate the value of expenses you might have made and seeking reimbursement to cover for your loss. 

Steps to Write a Letter for Car accident claims. 

Several elements should be in your claim letter. 

  •  Your claim letter should clearly explain the complaint, and the incident caused. 
  •  It should be able to define the level of damage and losses suffered. 
  •  The letter should be able to present fact statements of what you consider a fair adjustment or replacement. 

You must be precise in your explanation and try to avoid threats and accusations hidden in between lines. Your car collided with mine when you entered Teaticket highway without prior horning. It has caused significant damage to my front bumper, the right light, indicator, and right side mirror. After the incident, you had agreed you were at fault. I also have signed statements by two witnesses who agree likewise. 

I am writing to you to arrange the payment for the repair of my car. Attached is a copy of the cost of the repair, covering the value of the above-listed damages. I have also attached a copy of the receipt from towing my vehicle from the scene of the accident. 

Please send me details of your insurer if you are insured. If you are not, do send me a cheque of $5,000 without 18 days. It is to pay for the repair cost of the damage you caused. If, at the end of 18 days, I do not receive payment, I will have to carry on legal actions.

RE: Auto Collision on March 10th, 2020

Dear Mr. Smith,

On March 10th, 2020, around 5:00, I was seriously injured in a car hit on Worcester road by your insured James Nodd. Due to the negligence of your insured, I have suffered injuries and pain, subsequent loss of wages in addition to out of pocket costs not budgeted. Although I still have pains at any slight movement, which might continue for a few months. I have reached a considerable level of medical improvement and have decided to write you a reasonable and equitable settlement demand to settle this incident. 

Fact:

On March 10th at approximately 5:00 pm,I was headed home from work through the Worcester road, under normal speed limits at 50 miles per hour, and on my seat belt. I had just stopped driving and was waiting for the headlight to show green so I’ll move. Suddenly and without warning, your insured moved out of Pleasant Valley Avenue at speed and hit my car directly. The brutal force of the impact pushed my car far into the road, toward the concrete ramp.

My head and leg had violently hit the side of the car; my right shoulder slammed against the steering wheel. I was helped out of my car in severe pain. Your insured pulled over to the side and got out of his car. When I asked your insured why he drove into my car, he explained that he must have been distracted. I called 911 and reported the collision. The Alabama police and medical team arrived, evaluated the situation, and also transferred me to the general hospital. Your insured stated he was not injured. 

Mr. Dior Fark, who was driving behind me in his car, witnessed the collision. Mr. Fark told the investigating officer how he saw your insured come out of Pleasant Avenue suddenly and drove into my vehicle, injuring me. I have also enclosed a copy of the police report showing that I had no part in the collision and that your insured was issued three traffic citations.

Injuries and Treatment. 

I have severe shoulder strain, and the hit to my head had caused a mild concussion. An MRI also confirms a shoulder separation. I am in bandages to restrict movement in that part, prescribed muscle relaxer and over the counter pain reliefs. I was referred to the orthopedic unit to follow up. 

As attached in Dr. Tim’s report, I will not to return to my job until I am better, as doing so might likely exacerbate the injuries and make a recovery difficult shortly. 

Out of Pockets Costs. 

Medication, bandages, and sling cost a total of $80 while covering the cost I made to and from medical appointments cost me $120. Complete out of pocket costs were $200.

Lost Wages. 

I have worked as a trucker for Neon industries for six years. At the time of this collision, I make $70 per hour. As a result of the injury, I do not receive any salary from work since the damage is not work-related. As a result, I will lose of 4,077 in wages as detailed by my employee, enclosed within. 

There is no way you can fully compensate for all I have suffered. I expect, at the least, as his representative to pay me for my injuries and damages.

How Does it Work? 

If you are sending a claim letter to another party who is at fault, your claim letter should prove that the mistake is theirs. Include the cost of car repairs, the date you need compensation or replacement, and the legal action you are likely to take if you are not paid by the time you specify in your letter. 

You should make copies and send the original by email, post, fax, or by hand. The other party would either agree to your claim and make arrangements to pay you or deny. This latter option could lead to a court case. Preferably the other party might decide to send an adjustment letter and also offer to negotiate for a lesser amount. 

If the other has an insurance policy, they might decide to claim their insurance. In such a case, you will get a claim number to contact the insurer directly. 

You may also send a claim letter to your insurer in the case of bodily injuries and damages for yourself and when you are at fault.
